This policy explains how In2Eyes Optometry (Jason Teh, trading as In2Eyes Optometry, 511 Whitehorse Road, Surrey Hills VIC 3127) collects, uses, stores and protects your personal and health information, and what rights you have in relation to it.

1. Who we are

In2Eyes Optometry is a Victorian optometry practice. We are regulated under the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth) and, because we hold health information, the Health Records Act 2001 (Vic).

2. Information we collect

Depending on how you interact with us, we may collect:

  • Contact details: name, phone number, email address.
  • Health information: your eye health history, symptoms, and answers you give us in consultations, forms or online self-assessment tools such as our Dry Eye Quiz.
  • Appointment and booking information.
  • Website usage information via cookies (see section 8).

3. Health information and online self-assessment tools

In2Eyes Optometry offers online tools on our website, such as symptom self-assessment quizzes, to help you understand your eye health. When you use one of these tools, we may collect the health information you choose to share, including your answers to symptom questions.

What we collect: this may include information about your eye symptoms, contact lens wear, and related history, along with your name, phone number and email address if you choose to share your contact details to receive your result or a follow-up.

Why we collect it: to give you a personalised result based on your answers, and, where you provide your contact details, to follow up with you about a possible appointment.

How we use it: your answers generate your personalised result at the time you complete the tool. If you share your contact details, a member of our team may follow up by phone, SMS or email regarding a possible appointment. Completing these tools is always optional, and we don’t use this information for any other purpose without your consent.

4. Marketing

We will not use health information collected through consultations or online tools for direct marketing purposes unless you have separately and explicitly consented to receive marketing communications from us. Where you do receive marketing messages (by SMS, email or phone), you can opt out at any time using the instructions provided or by contacting us directly.

5. How we store and protect your information

Patient and quiz information is stored in our practice management and CRM system (built on the HighLevel platform). HighLevel does not host data on its own premises; it uses established cloud infrastructure providers (Google Cloud Platform and Amazon Web Services) to store and process customer data, with encryption in transit and at rest.

Subject to the above, we take reasonable technical and organisational steps to protect your information from loss, misuse or unauthorised access, and limit access to staff who need it to do their job.

6. Third parties who may process your information

Confirmed from our account settings: patient SMS messages and calls are sent through LC Phone, and patient emails are sent through LeadConnector Email System, both are core infrastructure of the HighLevel platform underlying our CRM, not separate third-party add-ons. Our website booking and quiz functionality also runs on this same platform.

We only share your information with a third-party provider where that provider has agreed to appropriate privacy and security standards. We do not sell or rent your personal information to anyone.

7. Overseas storage or processing

Our practice is based in Australia. The CRM platform we use (built on HighLevel) stores and processes data using Google Cloud Platform and Amazon Web Services infrastructure, which may include locations outside Australia.

8. Cookies

Our website may use cookies and similar technologies to understand how visitors use the site (for example, page visits and length of visits). You can control or disable cookies through your browser settings; some website features may not work as intended if you do.

9. How long we keep your information

We keep patient records for the period required under Victorian health records law. 

10. Accessing and correcting your information

You can request access to, or correction of, the personal or health information we hold about you at any time by contacting us using the details in section 12. We will respond within a reasonable time and take reasonable steps to correct any information that is inaccurate.

11. How to make a complaint

If you have a concern about how we’ve handled your personal or health information, please contact us directly in the first instance using the details below, and we will aim to resolve it promptly.

If you’re not satisfied with our response, you can complain to:

  • The Health Complaints Commissioner Victoria (hcc.vic.gov.au), for complaints about health information specifically, or
  • The Office of the Australian Information Commissioner (oaic.gov.au), for privacy complaints generally.
